Disputes & Litigation

Disputes are legal conflicts that sometimes can only be resolved through court or arbitral proceedings. Other forms of dispute resolution include mediation and binding advice. In many cases, a settlement reached through negotiation and recorded in a settlement agreement is preferable to litigation.

However, litigation is sometimes unavoidable. This includes proceedings on the merits in first instance and on appeal, as well as interim relief proceedings such as preliminary injunctions and Enterprise Chamber proceedings. I am also involved in prejudgment and enforcement attachments, enforcement disputes and strategic litigation where timing and pressure play an important role.

Arbitration also forms a structural part of the practice, both nationally and internationally, under various arbitration institutes.


Experience

  • In summary proceedings, successfully prevented the private enforcement by a mortgagee of a €2 million real estate financing and reached a settlement.
  • Guidance of a business mediation between two brothers, bringing a long-running dispute to a definitive end.
  • Preparation of an international arbitration between a major electronics manufacturer and a specialised Danish tech company, which was avoided through timely negotiation.
  • Assistance to garage companies and car dealers in disputes regarding non-conformity, warranty and termination or rescission of purchase agreements.
  • Experience with arbitrations under, inter alia, ICC, NAI, SGOA and RvA rules in technology, industrial and construction-related disputes.
